BACKGROUND AND PURPOSE

 

Many Texas beauty schools and colleges are experiencing a shortage of qualified instructors. The instructor shortage is causing a delay in conducting classes and preventing timely graduation of students, and in some cases, limiting enrollment. The quality of instruction could be increased using more experienced operators who would be willing to be provisional instructors.

 

HB 3978 will require the Texas Department of Licensing & Regulation to issue a provisional instructor license to qualified applicants.  

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

HB 3978 amends the Occupations Code by providing for a Provisional Instructor License. HB 3978 requires the Texas Department of Licensing & Regulation (department) to issue a provisional license as an instructor to an applicant who has completed at least three years of current verifiable experience as a licensed operator; requires the department to issue an instructors license to a provisional license holder who has completed the required hours of instruction in cosmetology in a commission-approved training program.

 

HB 3978 provides that a provisional instructor license issued is valid for one year from the date the license is issued and may be renewed not more than two times.

 

HB 3978 provides that not more than 50 percent of the instructors at a beauty culture school or other place of business where cosmetology is taught may hold a provisional instructor license.

 

EFFECTIVE DATE

 

Immediately, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
