AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 3979 creates the McKinney Municipal Utility District No. 1 of Collin County and McKinney Municipal Utility District No. 2 of Collin County, each of which will both encompass an area of land inside the extraterritorial jurisdiction of the City of McKinney, Texas.  The land to be located within the districts will be developed into single-family residential and commercial development; therefore, water, sewer, drainage and road services need to be secured.  It is necessary to empower the districts with authority to impose a tax and issue bonds; granting the power of eminent domain. This bill provides regulations regarding the creation, administration, powers, duties, operation, and financing of the districts. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapters 8223 and 8252, as follows:

 

CHAPTER 8223.  McKINNEY MUNICIPAL UTILITY DISTRICT

NO. 1 OF COLLIN COUNTY

 

Sets forth standard language for the creation of the McKinney Municipal Utility District No. 1 (district 1) in Collin County. Sets forth standards, procedures, requirements, and criteria for:

 

Creation, definitions, nature, and approval of district 1 (Sections 8223.001-8223.020);

 

Size, composition, election, and terms of the board of directors of district 1 (Sections 8223.021-8223.100);

 

Powers and duties of district 1 (Sections 8223.101-8223.150); and

 

General financial provisions and authority to impose taxes and to issue bonds and obligations for district 1 (Sections 8223.151-8216.201).

 

Authorizes the use of eminent domain by district 1.

 

CHAPTER 8252.  McKINNEY MUNICIPAL UTILITY DISTRICT

NO. 2 OF COLLIN COUNTY

 

Sets forth standard language for the creation of the McKinney Municipal Utility District No. 2 (district 2) in Collin County. Sets forth standards, procedures, requirements, and criteria for:

 

Creation, definitions, nature, and approval of district 2 (Sections 8252.001-8252.020);

 

Size, composition, election, and terms of the board of directors of district 2 (Sections 8252.021-8252.100);

 

Powers and duties of district 2 (Sections 8252.101-8252.150); and

 

General financial provisions and authority to impose taxes and to issue bonds and obligations for district 2 (Sections 8252.151-8252.201).

 

Authorizes the use of eminent domain by district 2.

 

SECTION 2. Sets forth the initial boundaries of district 1.

 

SECTION 3.  Sets forth the initial boundaries of district 2.

 

SECTION 4.  Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 6.  Effective date: September 1, 2007.
