AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The Galveston County Municipal Utility District No. 67 (district) encompasses an area of land inside the corporate limits of the City of Texas City, Texas.

 

H.B. 3980 extends the confirmation deadline for the district and provides the district with the powers of a navigation district.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 8151.003, Special District Local Laws Code, as follows:

 

Sec. 8151.003.  CONFIRMATION ELECTION REQUIRED.  Provides that if the creation of the Galveston County Municipal Utility District No. 67 (district) is not confirmed at a confirmation election held under Section 8151.023 (Confirmation and Initial Directors' Election) before September 1, 2009, rather than 2007, the district is dissolved September 1, 2009, rather than 2007, and provides certain exceptions.  Provides that this chapter (Galveston County Municipal Utility District No. 67) expires September 1, 2011, rather than 2010.

 

SECTION 2.  Amends Section 8151.025, Special District Local Laws Code, as follows:

 

Sec. 8151.025.  EXPIRATION OF SUBCHAPTER.  Provides that this subchapter (Temporary Provisions) expires September 1, 2011, rather than 2010.

 

SECTION 3.  Amends Subchapter C, Chapter 8151, Special District Local Laws Code, by adding Section 8151.106, as follows:

 

Sec. 8151.106.  NAVIGATION DISTRICT POWERS.  Authorizes the district to use certain navigation district powers.

 

SECTION 4.  Amends Section 8151.201(a), Special District Local Laws Code, to authorize the district to issue bonds or other obligations as provided by Chapters 49 (Provisions Applicable to All Districts) and 54 (Municipal Utility Districts), Water Code, payable wholly or partly from ad valorem taxes, impact fees, revenue, grants, or other district money, to finance any district purpose, rather than to finance the construction, maintenance, or operation of projects under Sections 8151.101 (Municipal Utility District Powers and Duties) and 8151.102 (Road Projects).

 

SECTION 5.  Provides that all requirements of the constitution and laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 6.  Effective date: upon passage or September 1, 2007.
