AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 3990 creates of a water control and improvement district (district) to be located entirely Burnet County, in the extra-territorial jurisdiction of the City of Cottonwood Shores. Cottonwood Shores sits in the middle of a quickly developing area in Central Texas on the Highland Lakes.  The proposed legislation includes already existing authorized powers from several Texas water district laws, combining them into this water district that will be suited for the needs of this area.  H.B. 3990 combines the traditional powers of a district governed by Chapters 49 and 51, Water Code, and a Municipal Utility District, governed by Chapters 49 and 54, Texas Water Code.  H.B. 3990 creates Burnet County Water Control and Improvement District No. 1 and enumerates its powers, duties and obligations. H.B. 3990 authorizes the district to have road powers pursuant to Article 3, Section 52, Texas Constitution.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 9030, as follows:

 

CHAPTER 9030.  BURNET COUNTY WATER CONTROL AND IMPROVEMENT DISTRICT NO. 1

 

Sets forth standard language for the creation of the Burnet County Water Control and Improvement District No. 1 (district). Sets forth standards, procedures, requirements, and criteria for:

 

Creation, definitions, nature, initial district territory, and approval of the district (Sections 9030.001-9030.020);

 

Size, composition, election, and terms of the board of directors of the district (Sections 9030.021-9030.100);

 

Powers and duties of the district (Sections 9030.101-9030.150);

 

General financial provisions(Sections 9030.151-9030.200); and

 

Authority to impose taxes and to issue bonds and obligations for the district (Sections 9030.201).

 

Authorizes the use of eminent domain by the district.

 

SECTION 2. Sets forth the initial boundaries of the district.

 

SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4. Effective date: September 1, 2007.
