AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, the two statutory county courts of Parker County are named County Court at Law and County Court at Law No. 2, which has caused some confusion.

 

H.B. 3992 clarifies the names of the two statutory county courts of Parker County by establishing County Court at Law No. 1 of Parker County and County Court at Law No. 2 of Parker County as the official titles.  The bill also clarifies that the county clerk serves as the clerk in concurrent cases between the county courts at law and the district courts.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 25.1861, Government Code, to provide that Parker County has two statutory county courts, the County Court at Law No. 1 of Parker County and the County Court at Law No. 2 of Parker County, and that the statutory county courts in Parker County sit in Weatherford.

 

SECTION 2.  Amends Section 25.1863(b), Government Code, to update references to the county court at law to refer to a county court at law in Parker County and the district court to refer to a district court in Parker County.

 

SECTION 3.  Repealer: Section 25.1862(e), Government Code (providing that the district clerk of Parker County serves as clerk of a county court at law in certain cases).

 

SECTION 4.  Provides that a reference in law to the County Court at Law of Parker County means the County Court at Law No. 1 of Parker County.  Provides that the judge of the County Court at Law of Parker County, unless otherwise removed as provided by law, continues to serve as judge of the County Court at Law No. 1 of Parker County for the remainder of the term to which the judge was elected or appointed, notwithstanding the change made by this Act to the name of the court.

 

SECTION 5.  Effective date: October 1, 2007.
