AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Collingsworth County Underground Water Conservation District (district) would like to annex some neighboring counties, change their name, and add additional directors to their board of directors.

 

H.B. 3995 authorizes the district to change its name and sets the number of single-member districts allowed in the district.  Makes certain other changes regarding the duties and functions of the district.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to any state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Chapter 376, Acts of the 69th Legislature, Regular Session, 1985, by amending Sections 1, 3, 4, 5, and 6 and by adding Section 4A, as follows:

 

Sec. 1.  CREATION OF DISTRICT.  Provides that the Collingsworth County Underground Water Conservation District (district) is authorized to perform certain duties as provide by Chapter 36 (Groundwater Conservation Districts), rather than Chapters 51 (Water Control and Improvement Districts) and 52 (Underground Water Conservation Districts), Water Code.

 

Sec. 3.  BOUNDARY OF DISTRICT.  Provides that the district includes all of the territory located in Collingsworth County and any territory annexed by the district.

 

Sec.  4.  PURPOSE OF DISTRICT.  Makes a conforming change.

 

Sec. 4A.  DISTRICT NAME CHANGE.  Authorizes the board of directors of the district board (board) by resolution to change the district's name.

 

Sec. 5.  POWERS AND DUTIES OF DISTRICT.  Makes a conforming change.

 

Sec. 6.  ADMINISTRATIVE PROCEDURES.  Makes a conforming change.

 

SECTION 2.  Amends Section 7(a), Chapter 376, Acts of the 69th Legislature, Regular Session, 1985, as follows:

 

(a) Requires the district, in addition to other requirements provided by law, to file certain documentation with the county treasurer of each county in whose jurisdiction the district, rather than Collingsworth County, is located.

 

SECTION 3.  Amends Section 12, Chapter 376, Acts of the 69th Legislature, Regular Session, 1985, as follows:

 

Sec.  12.  New heading:  ANNEXATION;  EFFECT ON BOARD OF DIRECTORS.  (a)  Creates this subsection from existing text.  Authorizes additional territory to be added to the district as provided by Chapter 36, rather than 49, Water Code.  Authorizes the board of directors to add additional single-member districts, rather than a sixth single member district, for the election of additional directors, rather than an additional director.

 

(b) Prohibits the district form containing more than 11 single-member districts.

 

SECTION 4.  Repealer:  Sections 8, 9, 11, 14, Chapter 376, Acts of the 69th Legislature, Regular Session, 1985.

 

SECTION 5.  Effective date: upon passage or September 1, 2007.
