BACKGROUND AND PURPOSE
H. B. 3995 provides for the Collingsworth County Underground Water Conservation District to change its name and sets the number of single-member districts allowed in the Water Conservation District. H.B. 3995 amends Chapter 376, Acts of the 69th Legislature, Regular Session, 1985 and references Chapter 36, Water Code instead of previous Chapters.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
ANALYSIS
SECTION 1. Amends Chapter 376 Sections 1, 3, 4, 5 and 6 and adds Section 4A. Sections 1, 4, 5, and 6 of the Chapter are amended to change references from Chapters 51 and 52 to Chapter 36, Water Code. Section 1 of the Chapter also refers to the water district as being in existence rather than being "created" by using the word "is". Section 3 of the Chapter is amended to include any territory annexed by the district to the Collingsworth County Underground Water Conservation District. New Section 4A of the Chapter is added to allow the name of the district to be changed through a resolution of the board.
SECTION 2. Amends Section 7(a), Chapter 376(a) requires the district to file copies of all audits, orders of the board and financial documents with county treasurer of each county located in the district.
SECTION 3. Section 12, Chapter 376 is amended to add new language to the title of the section to include EFFECT ON BOARD OF DIRECTORS. Section 12(a) changes a reference from Chapter 49 to Chapter 36, Water Code and provides for the addition of single-member districts for the election of additional directors. Section 12(b) provides that the district may contain no more than 11 single-member districts.
SECTION 4. Sections 8, 9, 11, and 14, Chapter 376, Acts of the 69th Legislature, Regular Session, 1985, are repealed.
SECTION 5. Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
