BACKGROUND AND PURPOSE

 

The Alief area of Houston has experienced rapid growth and development but municipal improvements have not kept up with that growth.

 

While there is a vital need for municipal improvements, the area is unlikely to receive the influx of funds it needs for these improvements.

 

Municipal management districts have been successful in supplementing the needs of many areas within larger Texas cities and have been successful, when managed correctly, at increasing property values and facilitating new development.

 

The proposed complete committee substitute for House Bill No. 4004 creates the International Management District to administer and provide funding for neighborhood improvement projects and services in the district.  It gives the area the power to improve economic stability and encourage revitalization and reinvestment in the Alief area.

 

The district will be a municipal management district similar to those operating pursuant to Chapter 375, Local Government Code, and Title 4, Special Districts Code.

 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a State officer, department, agency, or institution.

 

 

SECTION-BY-SECTION ANALYSIS

 

SECTION 1.  INTERNATIONAL MANAGEMENT DISTRICT.  Amends Title 4C, Special District Local Laws Code, by adding Chapter 3849.

SUBCHAPTER A.  GENERAL PROVISIONS.  Sets forth general provisions.

 

SUBCHAPTER B.  BOARD OF DIRECTORS.  Sets forth provisions for the board of directors.

 

SUBCHAPTER C.  POWERS AND DUTIES.  Sets forth powers and duties of the district.

 

SUBCHAPTER D.  FINANCIAL PROVISIONS.  Sets forth financial provisions for the district.

 

SUBCHAPTER E.  DISSOLUTION.  Sets forth provisions for the dissolution of the district.

 

SECTION 2.  BOUNDARIES.  Sets forth the boundaries for the district.

 

SECTION 3.  LEGISLATIVE FINDINGS.  Sets forth legislative findings.

 

SECTION 4.  EFFECTIVE DATE.  Effective date:  upon passage (if a two-thirds vote is obtained) or September 1, 2007.

 

 

EFFECTIVE DATE

 

Upon passage if the Act receives the constitutionally-required vote of at least two-thirds of the members of each house of the Legislature.  Otherwise, on the default date of September 1, 2007.

 

 

COMPARISON OF ORIGINAL TO SUBSTITUTE

 

SECTION 1.   The original bill has 11 blank spaces where the "INITIAL VOTING DIRECTORS" are listed.   The Substitute, however, fills in ten of the 11 spaces of the "INITIAL VOTING DIRECTORS" with names.

 

The substitute inserts the following language that is not present in the original, "this subsection does not diminish or disturb the rights and obligations of an electric utility or a telephone or telegraph corporation under Sections 181.042 and 181.082, Utilities Code."
