AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 4019 amends the powers of Cinco Southwest Municipal Utility District No. 4 (district).  The district lies within the extraterritorial jurisdiction of the City of Houston and in Fort Bend County.  Currently, the district provides water, sewer, drainage and park facilities to land located within the boundaries of the district. This bill provides the district with limited road powers pursuant to Article 3, Section 52 of the Constitution of Texas.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8227, as follows:

 

CHAPTER 8227. CINCO SOUTHWEST MUNICIPAL UTILITY DISTRICT NO. 4

 

Sets forth standard language granting additional authority to the Cinco Southwest Municipal Utility District No. 4 (district). Sets forth standards, procedures, requirements, and criteria for:

 

General provisions (Sections 8227.001-8227.050);

 

Powers and duties of the district, including authority relating to road projects (Sections 8227.051-8227.100); and

 

General financial provisions and authority to impose a tax and issue bonds and obligations for the district (Section 8227.101).

 

Authorizes the use of eminent domain by the district.

 

SECTION 2. Provides that the district retains all the rights, powers, privileges, authority, duties, and functions that it had before the effective date of this Act.

 

SECTION 3.  Provides that all requirement of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4.  Effective date: upon passage or September 1, 2007.
