AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, the land located within the boundaries of the proposed municipal utility district, the extraterritorial jurisdiction of the City of Alvin in Brazoria County, Texas, is being developed as a master planned community to include single-family home sites and commercial development.

 

H.B. 4031 creates the Brazoria County Municipal Utility District No. 62 (district). This bill provides that the territory of the district would lie within the extraterritorial jurisdiction of the City of Alvin. This bill also provides that the district would have all the powers granted to municipal utility districts operating pursuant to Chapters 49 (Provisions Applicable to All Districts) and 54 (Municipal Utility Districts), Water Code, and with road powers pursuant to Section 52 (Counties, Cities, or Other Political Corporations or Subdivisions; Lending Credit; Grants; Bonds), Article III, Texas Constitution.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8213, as follows:

 

CHAPTER 8213.  BRAZORIA COUNTY MUNICIPAL UTILTIY DISTRICT NO. 62

 

Sets forth standard language for the creation of the Brazoria County Municipal Utility District No. 62 (district) in Brazoria County.  Sets forth standards, procedures, requirements, and criteria for:

 

Definitions, nature, creation and voter approval of the district (Sections 8213.001-8213.020);

 

Size, composition, and terms of the board of the directors of the district (Sections 8213.021-8213.100);

 

General powers and duties of the district (Sections 8213.101-8213.150);

 

Authority of district to impose a tax and issue bonds (Sections 8213.151-8213.201); and

 

Authorizes the use of the power of eminent domain by the district. 

 

SECTION 2.  Sets forth the territory to be included in the district.

 

SECTION 3.  Provides that all requirements of the constitution and laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished. 

 

SECTION 4.  Effective date: September 1, 2007.
