AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Colorado City is underlain by significant but unquantified groundwater resources.  The creation of a countywide groundwater conservation district pursuant to Article XVI, Section 59, Texas Constitution will provide local management of groundwater resources.

 

C.S.H.B. 4032 creates the Colorado City Groundwater Conservation District and provides that the district must be confirmed by voters of Colorado County.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle H, Title 6, Special District Local Laws Code, by adding Chapter 8824, as follows:

 

CHAPTER 8824.  COLORADO COUNTY GROUNDWATER CONSERVATION DISTRICT

 

Sets forth standard language for the creation of the Colorado County Groundwater Conservation District. Sets forth standards, procedures, requirements, and criteria for:

 

Creation, definitions, nature, initial district territory, and approval or dissolution of the district (Sections 8824.001-8824.020);

 

Size, composition, election, and terms of the temporary board of directors of the district (Sections 8824.021-8824.050);

 

Board of directors, terms, and compensation of directors (Sections 8824.051-8824.100);

 

Powers and duties of the district (Sections 8824.101-8824.150);

 

General financial provisions and authority to impose taxes and to issue bonds and obligations for the district (Sections 8824.151-8824.200); and

 

Dissolution of the district (Sections 8824.201-8824.205).

 

Prohibits the use of eminent domain by the district.

 

SECTION 2. Repealer: Chapter 303 (relating to the creation, administration, powers, duties, operation, and financing of the Post Oak Groundwater Conservation District), Acts of the 77th Legislature, Regular Session, 2001.

 

SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4. Effective date: upon passage or September 1, 2007.
