AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Ledbetter Utility District No. 1 of Kaufman and Rockwall Counties (district) will encompass an area of land inside the extraterritorial jurisdiction of the City of McLendon Chisholm, Texas. The land to be located within the district will be developed into single family residential and commercial development. Therefore, water, sewer, drainage and road services need to be secured. It is necessary to create the district under Chapters 49 and 54, Water Code, in order to purchase, acquire, or construct facilities for such services to serve the future occupants of the land utilizing tax exempt bonds. It is also necessary to empower the district with authority to impose a tax and issue bonds; granting the power of eminent domain.
As proposed, H.B. 4033 provides regulations regarding the creation, administration, powers, duties, operation, and financing of the district.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8220, as follows:
CHAPTER 8220. LEDBETTER UTILITY DISTRICT NO. 1 OF KAUFMAN AND ROCKWALL COUNTIES
Sets forth standard language for the creation of the Ledbetter Utility District No. 1 (district) of Kaufman and Rockwall Counties. Sets forth standards, procedures, requirements, and criteria for:
Creation, definitions, nature, approval of the district, district territory, size, composition, election (Sections 8220.001-8220.050);
Terms of the board of directors of the district (Sections 8220.0051-8220.100);
Powers and duties of the district (Sections 8220.101-8220.150);
General financial provisions and (Sections 8220.151-8220.200); and
Authority to impose taxes and to issue bonds and obligations for the district (Sections 8220.201).
Authorizes and limits the use of eminent domain by the district.
SECTION 2. Sets forth the initial boundaries of the district.
SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.
SECTION 4. Effective date: September 1, 2007.
