AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 4034 creates Ledbetter Utility District No. 2 of Kaufamn and Rockwall Counties (district).  The land located within the district will be developed into single family residential and commercial development;  therefore, water, sewer, drainage and road services need to be secured.  The district must be created under Chapters 49 (General Law Districts) and 54 (Municipal Utility Districts), Water Code, in order to utilize tax exempt bonds to purchase, acquire, or construct facilities to provide the necessary services.  The bill sets forth the necessary provisions regarding the creation, administration, powers, duties, operation, and financing of the district.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to any state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8246, as follows:

 

CHAPTER 8246.  LEDBETTER UTILITY DISTRICT NO.  2 OF KAUFMAN AND ROCKWALL COUNTIES

 

Sets forth standard language for the creation of the Ledbetter Utility District No. 2 of Kaufman and Rockwall Counties (district). Sets forth standards, procedures, requirements, and criteria for:

 

Creation and approval of the district (Sections 8246.001-8246.050);

 

Size, composition, election, and terms of the board of directors of the district (Sections 8246.051-8246.100);

 

Powers and duties of the district, including authority relating to road projects (Sections 8251.101-8251.150); and

 

General financial provisions and authority to imposes taxes and issue bonds and obligations for the district (Sections 8246.151-8246.201).

 

Authorizes the use of eminent domain by the district.

 

SECTION 2. Sets forth the initial boundaries of the district.

 

SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4. Effective date: September 1, 2007.
