AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

The current statute for the Moore County Hospital District (district) was passed in 1969. Since that time, the county has grown substantially and the district’s duties have increased with that growth.  Current law regarding the district limits the district’s ability to hire employees.

H.B. 4035 authorizes the district’s board of directors (board) to hire physicians or other health care providers as it deems necessary.  The bill also authorizes the board to delegate to the administrator or manager of the district the authority to hire employees other than physicians for the hospital district.

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 5, Chapter 287, Acts of the 61^st Legislature, Regular Session, 1969, to authorize the board of directors (board) of the Moore County Hospital District (district) to employ physicians or other health care providers as the board considers necessary for the efficient operation of the district.  Provides that this section does not authorize the board to supervise or control the practice of medicine, as prohibited by Subtitle B (Physicians), Title 3, Occupations Code.  Authorizes the board to delegate to the administrator or manager the authority to employ technicians, nurses, and employees of the district other than physicians.

SECTION 2.  Effective date: upon passage or September 1, 2007.
