AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Continuing development and growth in southern Montgomery County has created the need for large-scale, permanent improvements such as water supply and distribution facilities, wastewater collection and treatment facilities, drainage and flood control projects, recreational facilities, and major thoroughfare improvements. 

 

H.B. 4046 creates the Montgomery County Municipal Utility District No. 104, and grants the district limited road powers, including the limited use of eminent domain.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8244, as follows:

 

CHAPTER 8244.  MONTGOMERY COUNTY MUNICIPAL UTILITY DISTRICT NO. 104

 

Sets forth standard language for the creation of the Montgomery County Municipal Utility District No. 104 (district). Sets forth standards, procedures, requirements, and criteria for:

 

Creation and approval of the district (Sections 8244.001-8244.050);

 

Size, composition, election, and terms of the board of directors of the district (Sections 8244.051-8244.100);

 

Powers and duties of the district, including authority relating to road projects (Sections 8244.101-8244.150); and

 

General financial provisions and authority to imposes taxes and issue bonds and obligations for the district (Sections 8244.151-8244.204).

 

Authorizes the limited use of eminent domain power by the district.

 

SECTION 2. Sets forth the initial boundaries of the district.

 

SECTION 3. Provides that all requirement of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4.  Sets forth certain legislative findings.

 

SECTION 5. Effective date: upon passage or September 1, 2007.
