BACKGROUND AND PURPOSE

 

The number of cases filed in the court system continues to grow. The purpose of this bill is to expand the jurisdiction of a county court at law in Erath County.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

The bill would amend the Government Code to grant jurisdiction to a county court at law in Erath County to hear civil cases in which the matter in controversy exceeds $5,000 but does not exceed $250,000, exclusive of interest, statutory or punitive damages and penalties, attorney's fees, and costs as alleged on the face of the petition. Current jurisdiction of such court is limited to proceedings under Chapter 262, Family Code, in which the Department of Protective Services has assumed the care, custody and control of a child.

 

EFFECTIVE DATE

 

September 1, 2007.
