AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

C.S.H.B. 4053 creates the Galveston Grand Beach0 Management District as a political subdivision of the state to administer and provide funding for community improvement projects and services in certain areas of the east end of the City of Galveston.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  GALVESTON GRAND BEACH MANAGEMENT DISTRICT.  Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3856, as follows:

 

CHAPTER 3856.  GALVESTON GRAND BEACH MANAGEMENT DISTRICT

 

Sets forth standard language for the creation of the Galveston East End Management District (district) as a political subdivision of this state. Sets forth standards, procedures, requirements, and criteria for:

 

Creation, definitions, purpose, declaration of intent, and findings relating to the district (Sections 3856.001-3856.004);

 

District territory and special zones  (Section 3856.005-3856.006);

 

Applicability of laws and construction of this chapter (Section 3856.007-3856.050);

 

Size, composition, election, and terms of the board of directors of the district; initial voting directors (Sections 3856.051-3856.100);

 

Powers and duties of the district (Sections 3856.101-3856.150);

 

General financial provisions and authority to impose taxes and issue bonds, contingent on voter approval; assessments and liens for assessments; and bonds and other obligations for the district (Sections 3856.151-3856.200); and

 

Dissolution of the district (Section 3856.201).

 

Prohibits the use of eminent domain by the district.

 

SECTION 2. BOUNDARIES.  Sets forth the initial boundaries of the district.

 

SECTION 3. LEGISLATIVE FINDINGS.  Sets forth the legislative findings related to the district.

 

SECTION 4. EFFECTIVE DATE.  Effective date: upon passage or September 1, 2007.
