AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
This bill creates a municipal utility district to be located entirely in Hays County and within the extra-territorial jurisdiction of the City of Dripping Springs. Dripping Springs lies in the middle of a quickly developing area of the Hill County and the proposed legislation includes powers already existing under Chapters 49 (Provisions Applicable to All Districts) and 54 (Municipal Utility Districts), Water Code, so that the district will be suited for the needs of the area it serves.
H.B. 4056 creates Hays County Municipal Utility District No. 6 (district) and enumerates its powers, duties, and obligations. H.B. 4056 specifically grants all powers in Chapters 49 (Provisions Applicable to All Districts) and 54 (Municipal Utility Districts), Water Code, to the district and authorizes the district to road powers pursuant to Article 3, Section 52, Texas Constitution, and Chapter 54 (Municipal Utility Districts), Water Code.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8297, as follows:
CHAPTER 8297. HAYS COUNTY MUNICIPAL UTILITY DISTRICT NO. 6
Sets forth standard language for the creation of the Hays County Municipal Utility District No. 6 (district). Sets forth standards, procedures, requirements, and criteria for:
Creation and approval of the district (Sections 8297.001-8297.050);
Size, composition, election, and terms of the board of directors of the district (Sections 8297.051-8297.100); and
Powers and duties of the district, including authority relating to road projects and the authority to impose taxes and issue bonds and obligation for the district (Sections 8297.101-8297.103).
Authorizes the limited use of eminent domain power by the district.
SECTION 2. Sets forth the initial boundaries of the district.
SECTION 3. Provides that all requirement of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.
SECTION 4. Effective date: upon passage or September 1, 2007.
