BACKGROUND AND PURPOSE

 

The Texas Department of Agriculture (TDA) currently administers child nutritional programs within the Texas public school systems.  These programs include the National School Lunch and School Breakfast Programs.  HB 4062 simply clarifies the authority of the Texas Department of Agriculture (TDA) to administer state and federal nutrition programs authorized by the U.S. Department of Agriculture and the state legislature. This bill also cleans up repetitive language and contradictory passages throughout the code.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

HB 4062 requires the Texas Department on Agriculture to have the authority to administer federal and state nutrition programs.  HB 4062 also clarifies administrative penalties for violations of certain provisions in section 12.020(c) of the Agriculture Code and repeals section 12.0012 of the Agriculture Code.

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
