AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, the Bermuda Reservoir is not a part of the Zavala-Dimmit Counties Water Improvement District (district).  The Bermuda Reservoir has been given to the district and needs to be annexed into the district. 

 

H.B. 4067 allows the district to annex all the areas that are within the Bermuda Reservoir into the district.  The bill does not impact any pre-existing water rights. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  DEFINITION.  Defines "district."

 

SECTION 2.  EXTENSION OF BOUNDARIES.  Provides that the Zavala-Dimmit Counties Water Improvement District (district) accepts as a gift and the boundaries of the district are extended to include all areas that are within the geographical boundaries of the Bermuda Reservoir located in Dimmit County, including the Live Oak Slough Dam and the Bermuda Dam, on the effective date of this Act.

 

SECTION 3.  FINDING OF BENEFIT.  Provides that all of the land and other property included within the boundaries of the district as extended by this Act will be benefited by the works and projects that are to be accomplished by the district under powers conferred by Section 59 (Conservation and Development of Natural Resources and Parks and Recreational Facilities; Conservation and Reclamation District), Article XVI, Texas Constitution.  Provides that the district is created to serve a public use and benefit.

 

SECTION 4.  DISTRICT AUTHORITY.  Authorizes the district to contract with any entity necessary to implement this Act.

 

SECTION 5.  EFFECTIVE DATE.  Effective date: upon passage or September 1, 2007.
