BACKGROUND AND PURPOSE

 

H.B. 4067 accepts the geographical boundaries of the Bermuda Reservoir, located in Dimmit County, to be incorporated into the Zavala-Dimmit Counties Water Improvement District No. 1.  The gift was unanimously approved in a resolution by the board of directors for the water district.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Defines "district" in this act to mean the Zavala-Dimmit Counties Water Improvement District No. 1.

 

SECTION 2.  Reads that the district accepts as a gift and the boundaries of the district are extended to include all the areas that are within the boundaries of the Bermuda Reservoir, including the Live Oak Slough Dam and the Bermuda Dam

 

SECTION 3.  States that all of the land and property found within the boundaries of the district as extended by this Act will be benefited by the works and projects that are to be accomplished by the district.  The district is created to serve a public use and benefit.

 

SECTION 4.  The district may contract with any entity necessary to implement this Act.

 

SECTION 5.  Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
