AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Currently, the land located within the boundaries of the proposed municipal utility district, located within the corporate limits of the City of Pearland and Harris County, is undeveloped.
H.B. 4080 creates Harris County Municipal Utility District No. 509 (district). This bill provides that the territory of the district would lie within the corporate limits of the City of Pearland and Harris County. This bill also provides that the district will have all of the powers granted to municipal utility districts operating pursuant to Chapters 49 (Provisions Applicable to All Districts) and 54 (Municipal Utility Districts), Water Code, and with road powers pursuant to Section 52 (Counties, Cities, or Other Political Corporations or Subdivisions; Lending Credit; Grants; Bonds), Article III, Texas Constitution.

SECTION 1. Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8217, as follows:
CHAPTER 8217. HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 509
Sets forth standard language for the creation of the Harris County Municipal Utility District No. 509 (district) in Harris County. Sets forth standards, procedures, requirements, and criteria for:
Creation and approval of the district (Sections 8217.001 - 8185.050);
Size, composition, election, and terms of the board of directors of the district (Sections 8217.051 - 8217.100);
Powers and duties of the district (Section 8185.101 - 8185.150); and
General financial provisions and authority to impose taxes and to issue bonds and obligations for the district (Sections 8158.151 - 8158.203).
Authorizes the use of eminent domain by the district.
SECTION 2. Sets forth the initial boundaries of the district.
SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.
SECTION 4. Effective date: upon passage or September 1, 2007.
