AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 4091 expands the Harris County Improvement District No. 6 (district).  The purpose of this bill is to expand the district to include both the east and west portions of Montrose into one management district.

 

The management district will be used to preserve the artistic and cultural character of the district, improve safety and security in the community, beautify the community in order to maintain and increase property values, provide investment opportunities, and enhance the quality of life for residents, business owners, and customers.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 3843.051(a), Special District Local Laws, to provide that the Harris County Improvement District No. 6 (district) is governed by a board of directors (board) of 13, rather than 11, directors who serve staggered terms of four years with six, rather than five, or seven, rather than six, directors' terms expiring June 1 of each odd-numbered year.

 

SECTION 2.  Amends Section 3843.053, Special District Local Laws, as follows:

 

Sec. 3843.053.  New heading:  BOARD.  (a)  Sets forth the composition of the board.

 

(b)  Provides that the terms of directors appointed for positions 1 through 6 expire June 1, 2011, and the terms of directors appointed for positions 7 through 13 expire June 1, 2009, rather than 2007.  Makes a conforming change.

 

(b-1)  Provides that the term of each membership position on the board as the term exists immediately preceding the effective date of the Act adding this subsection expires on that effective date.  Provides that, on that date, a new board is appointed as provided by Subsection (a) to serve terms as provided by Subsection (b).

 

(c)  Makes no changes to this subsection.

 

(d)  Provides that this section expires September 1, 2011, rather than 2009.

 

SECTION 3.  Amends Section 2, Chapter 769, Acts of the 79th Legislature, Regular Session, 2005, to set forth the boundaries of the district.

 

SECTION 4.  Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage or this Act are fulfilled and accomplished.

 

SECTION 5.  Effective date: upon passage or September 1, 2007.
