AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 4093 proposes the legislative creation of an improvement district to be located partially in Chambers County and partially in Liberty County, an area desirable for commercial and industrial development.  This bill proposes to combine the traditional powers and duties of a municipal utility district governed by Chapters 49 (Provisions Applicable to All Districts) and 54 (Municipal Utility Districts), Water Code, and the powers of a municipal management district governed by Chapter 375 (Municipal Management Districts in General), Local Government Code.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  CHAMBERS-LIBERTY COUNTIES IMPROVEMENT DISTRICT.  Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3857, as follows:

 

CHAPTER 3857.  CHAMBERS-LIBERTY COUNTIES IMPROVEMENT DISTRICT

 

Sets forth standard language for the creation of the Chambers-Liberty Counties Improvement District (district).  Sets forth standards, procedures, requirements, and criteria for:

 

Creation and approval of the district (Sections 3857.001 - 3857.050);

 

Size, composition, election, and terms of the board of directors of the district (Sections 3857.051 - 3857.100);

 

Power and duties of the district (Section 3857.101 - 3857.150);

 

General financial provisions and authority to impose taxes and to issue bonds and obligations for the district (Sections 3857.151 - 3857.200); and

 

Dissolution of the district (Section 3857.201).

 

Prohibits the use of eminent domain by the district.

 

SECTION 2.  Sets forth the initial boundaries of the district.

 

SECTION 3.  Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4.  Effective date: upon passage or September 1, 2007.
