AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, there is some confusion in Midland County regarding court fees for cases filed in the county court at law and those in the district court, even though both may have the same jurisdiction over that type of case.

 

H.B. 4094 allows for uniform fees in Midland County in cases where there is overlapping civil jurisdiction in statutory county courts at law and district courts.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 25.1672, Government Code, by adding Subsection (e), to provide that the fees assessed in a case in which a county court at law has concurrent civil jurisdiction with the district court are the same as the fees that would be assessed in the district court for that case.

 

SECTION 2.  Makes application of this Act prospective.

 

SECTION 3.  Effective date: September 1, 2007.
