AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
H.B. 4101 amends the powers of the Talley Ranch Water Control and Improvement District No. 1 of Denton County (district) to provide the district with limited road powers pursuant to Chapters 49 (Provisions Applicable to All Districts) and 51 (Water Control and Improvement Districts), Water Code, and Section 52 (Counties, Cities or Other Political Corporations or Subdivisions; Lending Credit; Grant; Bonds), Article III, Texas Constitution, in order to purchase, acquire, or construct facilities for such roads to serve the future occupants of the land utilizing tax-exempt bonds. The district lies within the extraterritorial jurisdiction of the City of Pilot Point in Denton County, Texas.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Subtitle I, Title 6, Special District Local Laws Code, by adding Chapter 9025, as follows:
CHAPTER 9025. TALLEY RANCH WATER CONTROL AND IMPROVEMENT DISTRICT NO. 1 OF DENTON COUNTY
Sets forth standard language regarding the Ranch Water Control and Improvement District No. 1 of Denton County (district). Sets forth standards, procedures, requirements, and criteria for:
Definitions, nature of the district, and applicability of other law (Sections 9025.001 - 9025.050);
Powers and duties of the district, including authority relating to road projects (Section 9025.051 - 9025.100); and
General financial provisions and authority to impose taxes and to issue bonds and obligations for the district (Sections 9025.101 - 9025.151).
Authorizes the use of eminent domain by the district.
SECTION 2. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.
SECTION 3. Effective date: September 1, 2007.
