AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
C.S.H.B. 4110 creates the Harris County Improvement District No. 9 (district). As a municipal utility district (MUD), the district is authorized by Section 59 (Conservation and Development of Natural Resources and Parks and Recreational Facilities; Conservation and Reclamation Districts), Article 16, Section 52 (Counties, Cities or Other Political Corporations or Subdivisions; Lending Credit; Grant; Bonds), Article 3, and Section 52-a (Loan or Grant of Public Money for Economic Development), Article 3, Texas Constitution, and governed by Chapter 49 (Provisions Applicable to All Districts) and Chapter 54 (Municipal Utility District), Water Code. The district would serve as a financing vehicle to purchase, acquire, and construct public infrastructure, such as water, sewer, drainage, and roadway facilities.
RULEMAKING AUTHORITY
Rulemaking authority is expressly granted to the Harris County Improvement District No. 9 in SECTION 1 (Sections 3859.153, Special District Local Laws Code) of this bill.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3859, as follows:
CHAPTER 3859. HARRIS COUNTY IMPROVEMENT DISTRICT NO. 9
Sets forth standard language for the creation of the Harris County Improvement District No. 9 (district) in Harris County, Texas. Sets forth standards, procedures, requirements, and criteria for:
Creation, definitions, nature, approval of the district, district territory, tort liability, and eligibility for reinvestment zones (Sections 3859.001-3859.050);
Size, composition, election, and terms of the board of directors of the district (Sections 3859.051-3859.100);
Powers and duties of the district (Sections 3859.101-3859.150);
Public transit system and parking facilities of the district (Sections 3859.151-3859.200);
General financial provisions and authority to impose taxes and to issue bonds and obligations for the district (Sections 3859.201-3859.250); and
Dissolution of the district (Sections 3859.251).
Authorizes the limited use of eminent domain by the district.
SECTION 2. Sets forth the initial boundaries of the district.
SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.
SECTION 4. Provides that Section 313.006 (Notice for Laws Establishing Municipal Management Districts), Government Code, does not apply to this Act.
SECTION 5. Effective date: upon passage or September 1, 2007.
