AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 4112 creates the Bolivar Yacht Basin Water Control and Improvement District No. 1 (district) of Galveston County in order to purchase, acquire, or construct facilities for navigation and road services to serve the needs of the district, which includes single-family residential and commercial property.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle I, Title 6, Special District Local Laws Code, by adding Chapter 9027, as follows:

 

CHAPTER 9027.  BOLIVAR YACHT BASIN WATER CONTROL AND IMPROVEMENT DISTRICT NO. 1 OF GALVESTON COUNTY

 

Sets forth standard language for the creation of the Bolivar Yacht Basin Water Control and Improvement District No. 1 (district) of Galveston County. Sets forth standards, procedures, requirements, and criteria for:

 

Creation, definitions, nature, and approval of the district (Sections 9027.001-9027.003);

 

Initial district territory (Section 9027.004);

 

Composition, election, and terms of the board of directors of the district, including an initial, temporary board (Sections 9027.021-9027.100);

 

Powers and duties of the district (Sections 9027.101-9027.150); and

 

General financial provisions and authority to impose taxes and to issue bonds and obligations for the district (Sections 9027.151-9027.201).

 

Authorizes the use of eminent domain by the district.

 

SECTION 2. Sets forth the initial boundaries of the district.

 

SECTION 3. Provides that all requirement of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4.  Effective date: September 1, 2007.
