BACKGROUND AND PURPOSE
In, the 77th Legislature, HB 3692, created the Greater Southeast Management District due to residents’ concerns about public safety and economic decline in their area. The district is authorized to impose an ad valorem tax and issue bonds to provide certain improvements and services that will promote the economic health and vitality of the area as a community and business center and provide for the general welfare of the public.
C.S.H.B. 4123 will extend the territory in the Greater Southeast Management District.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
ANALYSIS
C.S.H.B. 4123 provides for the extension of the Greater Southeast Management District to the southern border of South Loop East and to the western border of South Main Street.
The bill also confirms that proper and legal notice of the intention to introduce this legislation ahs been published and given to all agencies, officials and entities required under law.
The bill also confirms that notice has been given to the Governor and the Texas Commission on Environmental Quality and that TCEQ has filed its recommendation with the Lt. Governor and the Texas House of Representatives. Also this bill further states that all requirements have been met under the constitution.
EFFECTIVE DATE
Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
COMPARISON OF ORIGINAL TO SUBSTITUTE
The Committee Substitute to House Bill 4123 differs from the original bill in that it extends the western border of the district from Highway 288 to South Main Street.
