AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 4134 creates the Harris County Improvement District No. 10 (district) as a political subdivision of this state to administer and provide funding for improvement projects and services in the district.  This bill provides that the district will be a municipal management district  similar to those operating pursuant to Chapter 375 (Municipal Management Districts in General), Local Government Code, and Title 4 (Development and Improvement), Special District Local Laws Code.

 

RULEMAKING AUTHORITY

 

Rulemaking authority is expressly granted to the Harris County Improvement District No. 10 in SECTION 1 (Section 3860.153, Special District Local Laws Code) of this bill.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3860, as follows:

 

CHAPTER 3860.  HARRIS COUNTY IMPROVEMENT DISTRICT NO. 10

 

Sets forth the standard language for the creation of the Harris County Improvement District No. 10 (district).  Sets forth standards, procedures, requirements, and criteria for:

 

Creation and approval of the district (Sections 3860.001 - 3860.050);

 

Size, composition, election, and terms of the board of directors of the district (Sections 3860.051 - 3860.100);

 

Powers and duties of the district (Sections 3860.101 - 3860.200);

 

General financial provisions and authority to impose taxes and assessments and to issue bonds and obligations for the district (Sections 3860.201 - 3860.250); and

 

Dissolution of district with outstanding debt (Section 3860.251).

 

Prohibits the district from exercising the power of eminent domain.

 

SECTION 2.  BOUNDARIES.  Sets forth the initial boundaries of the district.

 

SECTION 3.  REIMBURSEMENT FOR COST OF CREATION.  Authorizes the district to reimburse the cost of creating the district from assessments or other revenue created by the district.

 

SECTION 4.  LEGISLATIVE FINDINGS.  Provides that all requirements of the constitution and laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 5.  INAPPLICABILITY OF NOTICE LAW.  Provides that Section 313.006 (Notice for Laws Establishing Municipal Management Districts), Government Code, does not apply to this Act.

 

SECTION 6.  EFFECTIVE DATE.  Effective date: upon passage or September 1, 2007.
