The commissioner's court of Van Zandt County has requested the creation of a county court at law. H.B. 4139 creates a county court at law in Van Zandt County
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Subchapter C, Chapter 25, Government Code, by adding Sections 25.2361 and 25.2362, as follows:
Sec. 25.2361. VAN ZANDT COUNTY. Provides that Van Zandt County has one statutory county court, the County Court at Law of Van Zandt County.
Sec. 25.2362. VAN ZANDT COUNTY COURT AT LAW PROVISIONS. Provides that, in addition to the jurisdiction provided by Section 25.0003 (Jurisdiction), a county court at law in Van Zandt County has, concurrent with the district court, the jurisdiction provided by the constitution and general law for district courts, except that the county court at law does not have jurisdiction in capital felony cases.
SECTION 2. Provides that the County Court at Law of Van Zandt County is created January 1, 2011.
SECTION 3. Effective date: January 1, 2011.

Committee Amendment
(1) Amends SECTION 1 of the bill (page 1, line 6), by striking "Sections 25.2361 and 25.2362" and substituting "Section 25.2361."
(2) Amends SECTION 1 of the bill (page 1, lines 9 through 14), by striking added Section 25.2362, Government Code.
