AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, Angelo State University is listed as a component of the Texas State University System in Section 17(b), Article VII, Texas Constitution.  A constitutional amendment is needed to ensure that Angelo State University's constitutional funding is continued if governance of the university is transferred by S.B. 1749, 80th Legislature, Regular Session.

 

H.J.R. 103 proposes a constitutional amendment to provide for the continuation of the constitutional appropriation for facilities and other capital items at Angelo State University on a change in the governance of the university by removing Angelo State University as a component of the Texas State University System administration and listing Angelo State University after the Texas Tech University Health Sciences Center.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 17(b), Article VII, Texas Constitution, to require funds appropriated under Subsection (a) (for facilities and other capital items) of this section to be for the use of Angelo State University on a change in the governance of the university.  Makes nonsubstantive changes.

 

SECTION 2.  Requires the proposed constitutional amendment to be submitted to the voters at an election to be held November 6, 2007.  Sets forth the required language of the ballot.
