AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Region L Water Planning Group failed to submit its water plan by the January 5, 2007, deadline to the Texas Water Development Board for approval and inclusion in the five-year state water plan beginning on January 5, 2007. This deadline currently prevents the Region L water plan from being validated.
As proposed, S.B. 181 validates a regional water plan submitted to the Texas Water Development Board after the deadline if it meets certain requirements.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. Validates all governmental acts and proceedings of the Texas Water Development Board (TWDB) related to the approval and inclusion in the state water plan for the five-year period beginning January 5, 2007, of a regional water plan (plan) that was submitted to TWDB after the deadline prescribed by Section 16.053(i) (Regional Water Plans), Water Code, as of the date they occurred if the plan was adopted by the applicable regional water planning group not later than January 19, 2006, and meets the other requirements of Section 16.053.
(b) Provides that this Act does not apply to acts or proceedings that are in litigation on the effective date of this Act that ultimately leads to a judgment of invalidity, or that are judged to be invalid on or before the effective date of this Act.
SECTION 2. Effective date: upon passage or September 1, 2007.
