AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Currently, noncommissioned officers of the Texas Department of Public Safety (DPS) are only authorized to detain and inspect commercial motor vehicles at a fixed-site facility.
As proposed, S.B. 330 allows DPS to utilize noncommissioned commercial motor vehicle inspection staff at all inspection sites located throughout Texas, including temporary roadside and weight inspection stations that are periodically set up to ensure commercial vehicle safety within the state. This legislation aims to put more commercial vehicle enforcement officers at inspection sites so as to increase safety and enforcement. In addition, this bill seeks to accommodate smaller counties where there is not a fixed-site weight station.

SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 621.402(c), Transportation Code, as follows:
(c) Authorizes a certified and supervised noncommissioned employee of the Department of Public Safety to weigh a vehicle, require a vehicle to be weighed, or require a vehicle to be driven to the nearest scale at a commercial motor vehicle inspection site, rather than a fixed-site facility, in addition to a port of entry.
SECTION 2. Amends Section 644.103(d), Transportation Code, to make a conforming change.
SECTION 3. Effective date: upon passage or September 1, 2007.
