BACKGROUND AND PURPOSE

 

Currently, Section 263.007, Local Government Code, allows counties to lease real property to federal, state, or local governmental entities and qualified non-profit and for-profit entities to conduct health and human services activities. Although these leases are not subject to the normal sealed-bid proposals process, it does require certain posting procedures. In the aftermath of hurricanes Rita and Katrina, Tarrant County was unable to respond to requests for short-term leases made by agencies seeking to serve evacuees who were temporarily relocated to the affected property due to the 30-day posting requirement.

 

S.B. 336 allows Tarrant County to lease real property for health and human services activities or other activities deemed to be in the public interest without the posting requirement if the lease is for less than 95 days and is for short-term emergency disaster relief services resulting from a disaster in the county or evacuees from another area.

 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

 

ANALYSIS

 

S.B. 336 amends Section 263.007(e) of the Local Government Code by amending Subdivision (3) and adding Subdivision (4) regarding the lease of property by certain counties when responding to emergency circumstances. This bill provides that a lease that is 95 days or less, or a short-term emergency lease, is not subject to the 30 day posting period under Subdivision (3).

 

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
