                                                                                                       Committee Report (Unamended)

BACKGROUND AND PURPOSE

Currently, the area of Kaufman County defined by this bill has not been created as a water control and improvement district.  The land to be located within this proposed district is to be developed into single-family residential and commercial development.  Therefore, water, sewer, drainage, and road services need to be secured.  In order to purchase, acquire, and construct facilities for such services, it is necessary to create a water and control improvement district under Chapters 49 (Provisions Applicable to All Districts) and 51 (Water Control and Improvement Districts), Water Code,  to serve the future occupants of the land by utilizing tax-exempt bonds.

S.B. 401 creates the Moore Farm Water Control and Improvement District No. 1 of Kaufman County (district) and sets forth the standards, procedures, requirements and criteria for the administration, powers, duties, operation, and financing of the district.  This bill also authorizes the district to impose a tax and issue bonds and other obligations.  The district will encompass an area of land within Kaufman County and outside the extraterritorial jurisdiction or corporate boundaries of any municipality.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
