AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Currently, the area of Kaufman County defined by this bill has not been created as a water control and improvement district. The land to be located within this proposed district is to be developed into single-family residential and commercial development. Therefore, water, sewer, drainage, and road services need to be secured. In order to purchase, acquire, and construct facilities for such services, it is necessary to create a water and control improvement district under Chapters 49 (Provisions Applicable to All Districts) and 51 (Water Control and Improvement Districts), Water Code, to serve the future occupants of the land by utilizing tax-exempt bonds.
As proposed, S.B. 401 creates the Moore Farm Water Control and Improvement District No. 1 of Kaufman County (district) and sets forth the standards, procedures, requirements and criteria for the administration, powers, duties, operation, and financing of the district. This bill also authorizes the district to impose a tax and issue bonds and other obligations. The district will encompass an area of land within Kaufman County and outside the extraterritorial jurisdiction or corporate boundaries of any municipality.

SECTION BY SECTION ANALYSIS
SECTION 1. Amends Subtitle I, Title 6, Special District Local Laws Code, by adding Chapter 9014, as follows:
CHAPTER 9014. MOORE FARM WATER CONTROL AND IMPROVEMENT DISTRICT NO. 1 OF KAUFMAN COUNTY
Sets forth standard language for the creation of the Moore Farm Water Control and Improvement District (district) in Kaufman County. Sets forth standards, procedures, requirements, and criteria for:
Creation and approval of the district (Sections 9014.001 - 9014.004);
Size, composition, election, and terms of the board of directors of the district (Sections 9014.021 - 9014.051);
Powers, duties, division, and dissolution of the district (Sections 9014.101 - 9014.104); and
General financial provisions and authority to issue bonds and obligations for the district (Sections 9014.151 and 9014.201).
Authorizes the use of eminent domain by the district.
SECTION 2. Sets forth the initial boundaries of the district.
SECTION 3. Provides that all requirements of the constitution and laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.
SECTION 4. Effective date: September 1, 2007.
