AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Current statute authorizes school boards to adopt rules preserving safety and welfare of students, employees, and property within the school district, and provides that a violation of such a rule is a Class C misdemeanor.

 

C.S.S.B. 443 repeals Section 37.102(c), Education Code, which contains the penalty for a violation of a district policy adopted under Section 37.102.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Repealer: Section 37.102(c) (relating to a penalty for certain traffic violations on a school district's property), Education Code.

 

SECTION 2.  Amends the heading to Section 37.102, Education Code, to read as follows:

 

Sec. 37.102. RULES.

 

SECTION 3. Effective date: September 1, 2007.
