AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
C.S.S.B. 513 requires an applicant for an independent dealer license to sell motor vehicles in Texas to complete a dealer education course approved by the Texas Department of Transportation.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 503.029, Transportation Code, by adding Subsections (d) and (e), as follows:
(d) Requires an applicant for an original dealer general distinguishing number who proposes to be an independent motor vehicle dealer and who does not hold another type of dealer general distinguishing number to submit to the Texas Department of Transportation (TxDOT) evidence that the applicant has completed a TxDOT-approved basic dealer education course in the year preceding the date the application is filed. Requires the course to be at least eight hours and not more than 12 hours in length.
(e) Authorizes TxDOT to approve a dealer education course under Subsection (d) only if the provider of the course meets certain conditions set forth in this subsection.
SECTION 2. Make application of this Act prospective to September 1, 2008.
SECTION 3. Requires TxDOT to begin approving or rejecting applications from basic dealer education course providers not later than January 1, 2008.
SECTION 4. Effective date: September 1, 2007.
