AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
The 78th Legislature created the Downtown Midland Management District (district) as a special district. Since its creation the district has purchased several properties and has begun the process of demolishing buildings in the downtown Midland area. Current law leaves the district open to liability. As a result, the district requires the validation of certain acts, including the purchase and sale of certain property.
As proposed, S.B. 524 validates the previous actions and proceedings of the Downtown Midland Management District, excepting certain matter under litigation.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. (a) Validates all governmental acts and proceedings of the Downtown Midland Management District since June 19, 2005, including acts and proceedings related to the purchase or sale of real property by the district, as of the dates on which they occurred.
(b) Provides that this section does not apply to any matter that on the effective date of this Act is involved in litigation if the litigation ultimately results in the matter being held invalid by a final court judgment, or has been held invalid by a final court judgment.
SECTION 2. Effective date: upon passage or September 1, 2007.
