AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
S.B. 545 makes changes to the population thresholds that determine the eligibility of a police officer in certain municipalities to become certified by the Department of Public Safety to enforce commercial motor vehicle safety standards.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to any state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Reenacts and amends Section [sic] 45.051(f), Code of Criminal Procedure, as amended by Chapters 281 and 357, Acts of the 79th Legislature, Regular Session, 2005, to delete existing text providing that this article (Suspension of Sentence and Deferral of Final Disposition) does not apply to an offense to which Section 729.004(b) (repealed), Transportation Code, applies.
SECTION 2. Amends Section 644.101(b), Transportation Code, to set forth that a police officer in a municipality with a population of 50,000, rather than 100,000, or more, in a municipality with a population of 25,000 of which any part is located in a county with a population of 500,000, rather than two million, or more, or in a municipality with a population of at least 34,000 that is located in a county that borders two or more states is eligible to apply for certification under this section (Certification of Certain Peace Officers).
SECTION 3. Effective date: September 1, 2007.
