AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
As proposed, S.B. 545 makes changes to the population thresholds that determine the eligibility of a police officer in certain municipalities to become certified by the Department of Public Safety to enforce commercial motor vehicle safety standards. Reducing the population threshold in Section 644.101(b)(1), Transportation Code from 100,000 to 50,000 would allow an additional 31 municipalities to become eligible to enforce the commercial motor vehicle safety standards. Reducing the county population from two million to 500,000 in Section 644.101(b)(2), Transportation Code, would allow municipalities with a population of 25,000 or more in an additional five counties (Tarrant, Bexar, Travis, Collins, and Denton) to become eligible to enforce the commercial motor vehicle safety standards. A total of 12 municipalities would be eligible in these five counties.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to any state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 644.101(b), Transportation Code, to set forth that a police officer in a municipality with a population of 50,000, rather than 100,000, or more, or in a municipality with a population of 25,000 of which any part is located in a county with a population of 500,000, rather than two million, or more, is eligible to apply for certification under this section (Certification of Certain Peace Officers).
SECTION 2. Effective date: September 1, 2007.
