AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The Stonewall County Hospital District was created under an Act of the 58th Legislature. The district's board of directors do not serve three-year staggered terms and are not on a timeline in accordance with the provisions of the Election Code.

 

As proposed, S.B. 605 requires the election timelines for the Stonewall County Hospital District to be in accordance with the Election Code, and authorizes the board of directors be elected to staggered three-year terms.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Sections 3(a) and (c), Chapter 54, Acts of the 58th Legislature, Regular Session, 1963, as follows:

 

(a) Provides that the Stonewall County Hospital District (district) is governed by a board of five directors elected at large by place for staggered three year terms. Deletes existing text relating to the election and creation of a hospital district.

 

(c) Requires the board of directors of the district to order a regular election of directors to be held each year on the May uniform election date under Section 41.001 (Uniform Election Dates), Election Code, in accordance with Chapter 3, Election Code. Requires notice of the election to be published in a newspaper of general circulation in the district in accordance with Section 4.003, Election Code. Requires any person desiring that person's name to be printed on the ballot as a candidate for director to file an application with the secretary of the board of directors of the district in accordance with Section 144.005 (Filing Deadline), Election Code. Deletes existing text relating to the date of the election, the time and location of the election, and the publishing of the notice of election.

 

SECTION 2. (a)  Requires the members of the board of directors of the district serving on the effective date of this Act to draw lots to determine in which place each director serves.  Requires the two directors whose terms expire in 2008 to draw lots for places 1 and 2 and the three directors whose terms expire in 2009 to draw lots for Places 3, 4, and 5.

 

(b)  Provides that the election of the board of directors of the district scheduled before the effective date of this Act to be held in May 2008. Requires the director elected for Place 1 at that election to serve a three-year term.  Requires the director elected for Place 2 at that election to serve a two-year term.

 

(c) Requires the election of the board of directors scheduled before the effective date of this Act to be held in May 2009. Requires the directors elected for Places 3 and 4 at that election to serve three-year terms.  Requires the director elected for Place 5 at that election to serve a two-year term.

 

(d)  Requires the directors elected at the elections to be held in May 2010, May 2011, and May 2012 to serve three-year terms.

 

SECTION 3. Effective date: upon passage or September 1, 2007.
