AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Currently, the commissioner of workers' compensation is required to serve as an ex officio member of the Texas Department of Information Resources (DIR) board but the Texas Workers' Compensation Commission (commission) has merged with the Texas Department of Insurance (TDI) as a separate division within TDI. The commissioner of workers' compensation now serves as the director of that division under the commissioner of insurance, and the DIR board membership does not reflect that change. Also, an ex officio board member is currently only authorized to designate that member's insurance agency's information resources manager (IRM) in the member's place.
As proposed, S.B. 655 designates the commissioner of insurance as an ex officio member of the DIR board and allows an ex officio member to designate a senior manager within the member's agency to serve in the member's place, rather than specifically designating the IRM.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Sections 2054.021(c) and (d), Government Code, as follows:
(c) Sets forth the composition of the ex officio members of the governing board of the Department of Information Services and the terms of service thereof. Requires that two groups serve on the board on a rotating basis. Specifies that the first group is composed of the commissioner of insurance, rather than the commissioner of workers' compensation, the executive commissioner of the Health and Human Services Commission, and the executive director of the Texas Department of Transportation.
(d) Authorizes an ex officio member to designate an employee on the management or senior staff level, rather than the information resources manager, of the member's agency to serve in the member's place.
SECTION 2. Effective date: upon passage or September 1, 2007.
