BACKGROUND AND PURPOSE
S.B. 682 creates the Fulshear Municipal Utility District No. 1 of Fort Bend County (district), authorizes the district to impose a tax, issue bonds, and grants the district the power of eminent domain. The district will encompass an area of land inside the corporate limits or extraterritorial jurisdiction of the City of Fulshear, Texas. The land to be located within the district will be developed into single family residential and commercial development requiring water, sewer, drainage, and road services.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
ANALYSIS
SECTION 1. Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8207, as follows:
CHAPTER 8207. FULSHEAR MUNICIPAL UTILITY DISTRICT
NO. 1 OF FORT BEND COUNTY
SUBCHAPTER A. GENERAL PROVISIONS
Sets forth standard language for the creation of the Fulshear County Municipal Utility District No. 1 (district) in Fort Bend County. Sets forth standards, procedures, requirements, and criteria for:
Creation and approval of the district (Sections 8207.001-8207.004);
Size, composition, election, and terms of the board of directors of the district (Sections 8207.021-8207.051)
Powers and duties of the district (Sections 8207.101-8207.103); and
General financial provisions and authority to issue bonds and other obligations for the district (Sections 8207.151-8207.201).
Sections 8207.005-8207.020, 8207.027-8207.050, 8207.052-8207.100, 8207.104-8207.150, 8207.152-8207.200 reserved for expansion.
SECTION 2. Sets forth the initial boundaries of the district.
SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.
SECTION 4. Effective date: September 1, 2007.
