AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Currently, the City of Rockport maintains the water system for Aransas County. Recently, the Aransas County Conservation and Reclamation District and locally elected officials agreed that the district no longer serves a purpose.
As proposed, S.B. 748 dissolves the district and transfers any remaining assets to the City of Rockport.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. DISTRICT TO BE DISSOLVED. Requires that the Aransas County Conservation and Reclamation District be dissolved as provided by this Act.
SECTION 2. TRANSFER OF ASSETS. Requires the board of directors of the Aransas County Conservation and Reclamation District to make certain payments and transfers by certain dates.
SECTION 3. DATE OF DISSOLUTION. (a) Provides that the Aransas County Conservation and Reclamation District is dissolved on July 1, 2007, if this Act receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution, or October 1, 2007, if this Act does not receive the vote necessary for immediate effect.
(b) Requires that any unsatisfied debt or legally established liability of the district be a charge on the assets transferred until paid.
SECTION 4. REPEALER. Repealer: Chapter 9302 (Aransas County Reclamation and Conservation District), Special District Local Laws Code, as added by Section 1.09, Chapter 729, Acts of the 79th Legislature, Regular Session, 2005, upon dissolution of the district.
SECTION 5. Effective date: upon passage or September 1, 2007.
