AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Chapter 142, Local Government Code, authorizes a municipality to adopt "meet and confer" rights for its police officers if the municipality has a population of 50,000 or more or has adopted Chapter 143 (Municipal Civil Service for Fire Fighters and Police Officers), but this law excluded certain municipalities that had adopted collective bargaining, including San Antonio.  However, collective bargaining in San Antonio does not apply to park and airport police officers, leaving these officers with no method of negotiation.

 

S.B. 772 provides meet and confer authority for certain park and airport police officers through peace officers associations.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 142.051, Local Government Code, to provide that this subchapter (regarding general provisions relating to assistance, benefits, and working conditions of municipal officers and employees) applies only to a municipality, and a police officer in a municipality, with a population of 50,000 or that has adopted Chapter 143 (Municipal Civil Service for Fire Fighters and Police Officers), or a police officer not covered by a collective bargaining adopted under Chapter 174 (Fire and Police Employee Relations) in a municipality that has adopted Chapter 174 for police officers in the police department, and the municipality that appoints or employs such a police officer, rather than only to a municipality with a population of 50,000 or more that has adopted Chapter 143.

 

(b)  Provides that this subchapter does not apply to a police officer who is covered by a collective bargaining agreement adopted under Chapter 174; a police officer who is covered by an agreement adopted under Subchapter H (Local Control of Fire Fighter Employment Matters in Municipalities with Population of 1.5 Million or More), Subchapter I (Fire Fighter and Police Officer Employment Matters in Certain Municipalities), or Subchapter J (Local Control of Police Officer Employment Matters in Municipalities with Population of 1.5 Million or More) of Chapter 143; a municipality that has a population of one million or more and has not adopted Chapter 143; or a municipality that has adopted Subchapter I, Chapter 143, in an election authorized by Section 143.3015 (Limitation on Municipalities Covered by Subchapter: Voter Approval), rather than a municipality that has adopted Chapter 174, is covered by Subchapter H, I, or J, Chapter 143, or has a population of one million or more and has not adopted Chapter 143.

 

SECTION 2.  Effective date:  September 1, 2007.
