BACKGROUND AND PURPOSE

 

Currently, active judicial officers are not required to attend the classroom instruction part of the continuing education proficiency course to renew a concealed handgun license.  It is unclear whether federal judges are included in this exemption.

 

S.B. 835 includes federal judges, who reside in this state, in the list of judicial officers who are exempt from attending the classroom instruction part of the continuing education proficiency course to renew a concealed handgun license.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

S.B. 835 amends Section 411.201(a)(1), Government Code, to include a federal judge who is a resident of this state in the definition of "active judicial officer."  The bill also makes conforming changes.

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
