AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The San Jacinto Water Supply Corporation (corporation) is a non-profit water supply corporation that provides retail water service in the areas of San Jacinto County and the City of Cold Spring. The corporation wishes to convert to a special utility district to benefit from the advantages of being a political subdivision of the state.

 

As proposed, S.B. 853 establishes the San Jacinto Special Utility District and dissolves the corporation.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle C, Title 6, Special District Local Laws Code, by adding Chapter 7211, as follows:

 

CHAPTER 7211.  SAN JACINTO SPECIAL UTILITY DISTRICT

 

Sets forth standard language for the creation of the San Jacinto Special Utility District (district) in San Jacinto County. Sets forth standards, procedures, requirements, and criteria for:

 

Creation and approval of the district (Sections 7211.001-7211.004);

 

Size and composition of the district, election of temporary directors, and size and qualifications of the board of directors (Sections 7211.005-7211.022; 7211.051-7211.052);

 

Transfer of assets and dissolution of the San Jacinto Water Supply Corporation and expiration of subchapter (Sections 7211.023-7211.024); and

 

Powers and duties of the district, authority to change a water service impact fee, and a limit on eminent domain power (Sections 7211.101-7211.103).

 

Authorizes the use of eminent domain by the district.

 

SECTION 2.  Sets forth the initial boundaries of the district.

 

SECTION 3.  Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4.  Effective date: upon passage or September 1, 2007.
