AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The definition of "institution" in the law regulating convalescent and nursing homes appears in Sections 242.002(6) (Definitions) and 242.002(10), Health and Safety Code.  In addition, Section 242.002, Health and Safety Code, has two sections numbered (6).  This bill deletes the duplicate definition listed in Section 242.002(6) and leaves the definition in Section 242.002(10).

 

C.S.S.B. 870 clarifies the definition of "institution" in Section 242.002, Health and Safety Code.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Reenacts Section 242.002(6), Health and Safety Code, as amended by Section 2, Chapter 693, Acts of 75th Legislature, Regular Session, 1997, and as renumbered as Section 242.002(10), Health and Safety Code, by Section 1.02, Chapter 1159, Acts of the 75th Legislature, Regular Session, 1997, as Subdivision (10), Section 242.002, Health and Safety Code, and amends it to redefine "institution."

 

SECTION 2.  Effective date: September 1, 2007.
